THIS DOCUMENT DESCRIBES HOW YOUR MEDICAL INFORMATION MAY BE USED AND DISCLOSED, AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.
Purpose
Homeland Health Specialists, Inc. (“HHSI”, “we”, “us” and “our”) respects your privacy. We are also legally required to maintain the privacy of your protected health information (“PHI”) under the Health Insurance Portability and Accountability Act (“HIPAA”). We are required by law to provide you with notice of our legal duties and privacy practices with respect to your PHI, including our duty to notify you following any data breach of PHI. We are required to abide by the terms of this Notice of Privacy Practices (“Notice”) so long as it remains in effect. We reserve the right to change the terms of this Notice as necessary and to make the new notice effective for all PHI maintained by us. Uses and Disclosures.
Your PHI may be released as provided below:
Treatment. To other healthcare professionals for the purpose of providing you with quality health care.
Payment. To your insurance provider for the purpose of receiving payment for health care services.
Healthcare Operations. For routine healthcare operations, such as records storage or quality review.
Family and Friends. With your approval, we may disclose your PHI to designated family, friends, and others who are involved in your care or in payment of your care. If you are unavailable, incapacitated, or facing an emergency medical situation and we determine that a limited disclosure may be in your best interest, we may share limited PHI with such individuals without your approval.
Other Disclosures.
- To coroners and/or funeral directors consistent with the law.
- To the Food and Drug Administration if necessary to report adverse events, product defects, or to participate in product recalls.
- To public or law enforcement officials in the event of an investigation, as permitted under applicable law, or to a public health authority to report an adverse drug reaction or other public health and safety issues.
Your Rights.
You have specific rights regarding your PHI.
- You have the right to request restrictions on the use of your PHI for treatment, payment, or operations or with certain persons involved in your care. For these requests, we are not required to agree except when the restriction request pertains to a disclosure to a health plan for purposes of carrying out payment or healthcare operations when the information pertains solely to a healthcare service for which we have been paid in full by you.
- You have the right to request we communicate with you about medical matters in a certain way or at a certain location.
- You have the right to review, inspect and receive a photocopy of your PHI. A fee may be charged for copies and mailing.
- You have the right to request changes to your PHI that we maintain about you if you feel that such PHI is incorrect or incomplete.
- You have the right to know who has accessed your PHI and for what purpose. We will provide one accounting a year for free, but will charge a reasonable, cost-based fee if you ask for another one within 12 months.
- You have the right to a copy of this Notice.
- If you have given someone medical power of attorney or if someone is your legal guardian, that person can exercise your rights and make choices about your PHI.
Exercising your rights. All requests must be in writing and mailed to the address provided above under “Contact”.
Complaints
If you believe your privacy rights have been violated, you may file a complaint to us in writing to the address provided above. You may also file a complaint with the Secretary of the U.S. Department of Health and Human Services at Office for Civil Rights, U. S. Department of Health and Human Services, 233 N. Michigan Ave., Suite 240, Chicago, IL 60601. There will be no retaliation for filing a complaint.
